These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.kalairgfx.com (the "Site") and the purchase of any products or services from Kalair Limited Co ("KalairGFX," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use this Site.

1. Eligibility and Use of the Site

You must be at least 18 years old or the age of majority in your jurisdiction to use this Site and place orders.

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Site in any way that violates applicable laws or regulations

  • Interfere with the security or operation of the Site

  • Attempt to gain unauthorized access to any portion of the Site or systems

2. Products and Services

KalairGFX manufactures and sells custom motocross, ATV, and off-road vehicle graphics kits and related products.

All products are made to order unless explicitly stated otherwise. Product images, colors, and previews are representative only and may vary due to monitor calibration, print processes, and material characteristics.

Fitment is designed for OEM plastics only unless otherwise stated. Fitment on aftermarket plastics is not guaranteed.

3. Orders and Order Acceptance

All orders placed through the Site are subject to acceptance by KalairGFX. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product availability

  • Errors in pricing or product information

  • Suspected fraud or unauthorized transactions

Once an order enters production, it may not be modified or canceled.

4. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change without notice.

Payment must be received in full before production begins. By submitting payment information, you represent and warrant that you are authorized to use the payment method provided.

We reserve the right to correct pricing errors and cancel affected orders.

5. Customization and Proofing

Customization details submitted by the customer (including name, number, spelling, and formatting) are printed exactly as provided.

Proofs are only provided when explicitly selected on the product page. If no proof option is selected, the order is sent directly to production without preview.

Customers are responsible for reviewing and approving proofs when provided. Approval authorizes printing exactly as shown. Delays in approval will delay production and shipment.

6. Production and Shipping

Production times are estimates and are not guaranteed. Shipping times are provided by carriers and are outside of our control.

Risk of loss transfers to the customer upon carrier pickup. KalairGFX is not responsible for delays, loss, or damage caused by shipping carriers.

7. Returns, Cancellations, and Reprints

Custom and personalized products are non-returnable and non-refundable except in cases of verified manufacturing defects or errors.

Cancellations are only possible within a short window after placing an order and before production begins.

Reprints are provided only for:

  • Wrong model or year printed

  • Missing panels

  • Verified manufacturing defects

Reprints are not provided for:

  • Installation errors

  • Crash or abrasion damage

  • Normal wear

  • Fitment on aftermarket plastics

  • Color preference or screen-to-print variation

All claims require order verification and photo documentation.

8. Intellectual Property

All content on the Site, including designs, graphics, logos, text, images, and software, is the property of KalairGFX or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or use any content without prior written consent.

Custom designs created by KalairGFX remain the intellectual property of KalairGFX unless otherwise agreed in writing.

9. User Submissions

Any information, images, logos, or designs you submit represent that you own or have the right to use such content.

You grant KalairGFX a non-exclusive license to use submitted content solely for the purpose of producing and fulfilling your order.

You agree to indemnify and hold KalairGFX harmless from any claims arising from the use of submitted content.

10. Disclaimer of Warranties

Products and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, KalairGFX shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of the Site or products.

Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless KalairGFX, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Site, violation of these Terms, or infringement of any rights.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Any legal action shall be brought exclusively in the state or federal courts located in Collin County, Texas.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site constitutes acceptance of the revised Terms.
